Answer: No. In fact, it could create more risk. If the terminated manager saw that you were hiring again for the position you were supposedly eliminating, they’d likely start thinking of reasons you would lie to them about why they were terminated.

What about the ACA reporting rules (e.g., 1095-Cs)? The IRS has not released the 2019 forms and instructions yet. We're also still waiting for IRS to announce various 2020 benefit limits (e.g., health FSA limit; 401(k) limits). We’re monitoring it all. We will update materials when IRS provides the info, and let you know on our blog.
